At Loop horizon, we take a keen interest in cookie / tag compliance. It’s one of the many areas where we support clients; helping them adhere to regulatory requirements and to their own data privacy standards, to mitigate brand and regulatory risks.
Developments in late 2023 and early 2024 from the UK’s Information Commissioner’s Office (ICO) – writing to 53 of the UK’s top 100 websites to warn of enforcement action if they did not make changes to their cookies to comply with data protection law – make this all-the-more relevant.
Very few brands are deliberately breaching the rules - they are customer centric and want to do the right thing for their customers… but mistakes can creep in over time, and occasionally things might be pushed over the edge to gain some short-term trading benefit.
The ICO is doing its role here, acting as the watchdog to make sure no-one strays over the line - intentionally or not. Often the biggest challenge is knowing if you are over the line - risking the attention of the ICO and potential addition to their watchlist.
Prompted by this, we wondered what the current state-of-play was in terms of tag and cookie compliance in the UK. To that end, we decided to scan over 160 homepages for brands who operate in the UK, covering the majority of the FTSE 100 (focusing on their customer-facing websites rather than corporate sites where possible) and a range of other interesting brands and industry sectors.
Our scan goes under the hood to answer whether companies are tracking users before they’ve had the chance to reject.
